Welcome to 9jawap® – a mobile-first, community-driven platform where creators, entrepreneurs, and everyday users connect, share, earn, and promote their brands.

By accessing or using the 9jawap app or website, you agree to be bound by the following Terms and Conditions. If you disagree, please refrain from using the platform.

1. Acceptance of Terms
By creating an account or using 9jawap, you agree to comply with and be legally bound by these Terms. These terms apply to all users of the platform.

2. User Accounts
- You must be at least 13 years old to use 9jawap. If you are between 13 and 18, you represent that you have parental or guardian consent to use 9jawap. Parents/guardians are responsible for the minor’s activities. 9JAWAP strictly prohibits Child Sexual Abuse and Exploitation (CSAE). Any such content will be removed and reported per our Child Safety Standards.
- You are responsible for your account and login credentials.
- You must not impersonate others, use false information, or misrepresent yourself.
- Accounts may not be transferred or sold without 9jawap’s written permission.

Users’ personal data will be handled per applicable data protection laws. 9jawap reserves the right to process and store data as necessary for platform operation. 9jawap complies with the Nigeria Data Protection Regulation (NDPR) and other applicable laws.

9jawap reserves the right to terminate accounts or discontinue services for any reason. If 9jawap terminates an account without cause, the user will be notified at least 30 days in advance and will receive a pro-rata refund of any unused subscription time, unless the termination is due to a violation of these Terms, suspected fraud, or abuse.

3. Content Guidelines
You may share content such as photos, videos, blogs, events, and reels, provided that:
- You are the original creator or have permission
- Your content does not promote hate, abuse, violence, or illegal activities
- Your content does not infringe on others’ rights
- You do not upload malware, spam, or engage in system abuse
Violations may result in content removal or account suspension without notice.

Users are responsible for ensuring they have the necessary rights and consents before uploading personal data of third parties to 9jawap. 9jawap disclaims liability for unauthorized sharing of personal data by users.

9jawap does not pre-screen user content and disclaims liability for materials uploaded by users. 9jawap reserves the right to remove or restrict any content that, in its judgment, could harm its brand, reputation, or community.

Users agree to indemnify, defend, and hold harmless 9jawap, its affiliates, officers, and employees from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from their content, conduct, or use of the platform. This indemnity does not apply to claims resulting from 9jawap's own gross negligence or willful misconduct. Users are solely responsible for the content they publish, and 9jawap disclaims all liability for disputes or damages arising from user interactions or reliance on user content.

9jawap disclaims liability for lost profits, business opportunities, or reputational harm arising from downtime, feature removal, or account suspension.

4. Community Conduct
To keep 9jawap safe and welcoming, you agree to:
- Avoid hate speech, harassment, or discrimination
- Refrain from scams, spam, or misleading promotions
- Use in-app reporting tools to flag abusive behavior
- Engage respectfully in posts, comments, messages, and groups

5. Intellectual Property
- You retain ownership of all content you upload
- By posting publicly, you grant 9jawap a non-exclusive, royalty-free license to display and promote your content
- We may highlight user content across the platform or in promotions, with credit. Uploading content does not transfer ownership to 9jawap; ownership remains with the creator. Users expressly consent to their content being used in 9jawap’s promotional materials, online or offline, without further notice or compensation, provided authorship is credited.

By uploading, you grant 9jawap the right to reproduce, adapt, and distribute your content solely for platform operation and promotion. We may edit or format user content for display purposes, but we will not alter the original meaning or intent of your work.

We respect your moral rights as a creator. While you grant us the right to adapt and reproduce your content for platform use, we will not intentionally mutilate or distort your work in a way that would be prejudicial to your honor or reputation, to the extent permitted by law.

Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

6. Monetization & Business Tools
6.1 Tip-Based Earnings
- Users may receive tips from others. Tips are voluntary, and payouts are subject to platform thresholds and review. 

9jawap reserves the right to withhold or deny payouts at its discretion, including for suspected low-quality content, inauthentic engagement, or policy violations.

6.2 Paid Posts & Content Access
- You may charge for access to specific posts or content. 9jawap may apply a platform fee to such transactions.

Tips, subscriptions, and paid content are voluntary contributions or access fees, not investments or guarantees of return.

6.3 Business Promotion Tools
- Users may use ad tools to boost posts or promote their brand. All ads must comply with advertising and content policies. Advertisers are solely responsible for claims arising from their ads. 9jawap disclaims liability for third-party advertising content.

Advertisers are solely responsible for compliance with applicable advertising and consumer protection laws. 9jawap assumes no liability for user-promoted products or services.

6.4 Referral Earnings
- Earnings from referrals (e.g., 30% of subscription payments) are tracked within the platform and subject to performance review and fraud checks.

7. Leader Basic 9ja Program
A paid subscription that gives creators access to:
- Monetization tools
- Featured member status
- Access to post blogs, reels, polls, pages, and more
- Invite and ad tools access

All payments, including tips, advertisements, and paid content access, are non-refundable, except as required by law or as expressly stated in these Terms. Subscriptions are non-refundable once activated and any associated benefits or features have been accessed or used.

Leader Basic 9ja Program Payouts:

• Eligible creators may be selected to earn rewards of up to ₦6,900/month.
• Rewards and payouts are discretionary incentives, not wages or employment compensation. Participation in the Leader Basic 9ja Program does not create an employment, partnership, or agency relationship with 9jawap.
• Participation in the Basic 9ja Program is completely voluntary. Earning rewards is not guaranteed and depends on your eligibility and selection by 9jawap. These rewards are discretionary incentives, not wages, benefits, or any form of employment compensation. 9jawap has no contractual obligation to pay you.
• To be considered, you must post a minimum of 12 quality posts/month (at least 3 per week) and maintain an active subscription for the entire payout month. See payout policy
• Rewards are competitive and limited. Meeting eligibility does not guarantee a payout, but 9jawap will clearly communicate any changes to eligibility criteria or the number of rewards available each month on the platform.
• Users who believe their payout decision was made in error may contact support to request a review of their case. This review is at 9jawap's discretion, and the original decision may be upheld.
• Users who subscribe late in the month (e.g., after the 15th) or who become active only near month-end will not be considered for that month’s payout.
• Users with expired subscriptions who renew will only become eligible for payout consideration in the following full calendar month, provided they meet all conditions.
• Users with active subscriptions but fewer than 12 posts will not qualify for payout.
• Users are prohibited from maintaining multiple accounts for the purpose of receiving duplicate payouts, tips, or benefits. Violations will result in termination and forfeiture of earnings.
• No user shall have a right, entitlement, or legitimate expectation of receiving rewards, regardless of past payouts or performance.

Leader Basic 9ja Program Reward System:

• Rewards are competitive and limited.
• Maximum payout: ₦6,900/month per selected creator. 
• The number of users selected for rewards each month is limited and may vary at 9jawap’s sole discretion.

9jawap is not responsible for delays caused by third-party payment processors, banks, or telecom operators. 9jawap shall not be responsible for failed, blocked, or reversed transactions caused by third-party payment processors, telecom operators, or banks.

Leader Basic 9ja Program Selection is based on:

• Content quality
• Engagement (likes, comments, shares, views)
• Community impact

Final decision rests with 9jawap’s sole discretion.

8. Advertising Campaigns
If you purchase ads or promotions:
- You agree to provide honest, accurate ad content
- Ad images must meet the size and quality guidelines
- Ads violating content, fraud, or misrepresentation policies may be removed
- Budget spent on banned campaigns is non-refundable. Except as required by applicable consumer protection law, refunds (if any) shall apply only to unused services not yet accessed, and will be processed solely at 9jawap’s discretion.

Refunds (if any) shall apply only to subscription fees for services not yet activated or accessed. No refunds will apply to partially used benefits, visibility boosts, ad spend, or promotional tools.

9. How the Leader Basic 9ja Program Works:
- Payouts are processed by the 7th of each month
- Users are responsible for keeping payment details accurate
- Payouts may be delayed or withheld in cases of suspected fraud, rule violations, or technical issues
- 9jawap reserves the right to adjust payout structure or thresholds at any time

10. Account Termination
Your account may be suspended or deleted without prior notice if you:
- Repeatedly violate these terms
- Attempt to abuse or exploit platform systems
- Engage in fraudulent monetization behavior
- Harm the platform’s brand or community

11. Limitation of Liability
9jawap is provided “as is” without warranties. We are not liable for:
- Content posted by users
- Downtime or technical issues
- Losses from tips, earnings, or advertising
- Indirect or incidental damages

9jawap does not guarantee continuous, uninterrupted access to the platform, and services may be temporarily unavailable without notice.

In no event shall 9jawap’s total liability exceed the amount paid by the user in the last 3 months.  9jawap shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, epidemics, strikes, acts of third-party service providers, or network outages, acts of government, or internet disruptions. This limitation applies regardless of the duration of the user’s subscription, claim type, or cause of action.

12. Updates to These Terms
We may update these Terms at any time. You will be notified of significant changes via email or an in-app notice. Continued use of the platform means you accept the updated terms. 9jawap reserves the right to modify, suspend, or discontinue any feature or service at any time without liability. Sections on liability, indemnity, and payouts survive account termination or platform closure.

These Terms are governed by and construed under the laws of the Federal Republic of Nigeria. Any disputes shall be subject to individual, binding arbitration. Users agree that any claims shall be brought exclusively in Nigerian courts. In the event of a dispute, parties agree to attempt resolution through mediation before pursuing litigation.

These Terms constitute the entire agreement between users and 9jawap, and any claims shall be brought exclusively in Nigerian courts.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain valid and enforceable.
